Joint operationIndian Intelligence agencies believe that Pakistan and China are acting in tandem. Additional Pakistani troops have been moved closer to the LoC in the Pakistan Occupied Kashmir sector as well as near the Punjab and Jammu borders. The Chinese People;s Liberation Army, which was very active from May 1 to May 18, has massed troops at 18 locations near the LAC. In seven locations in Ladakh they had crossed the border, and of these, in five positions they moved 3 to 4 km inwards. The Chinese forward movement was accompanied by the building of huts, bunkers and roads. Since then there has been some pull back of Chinese forces.Bypassing chiefGeneral Bipin Rawat became the first Chief of Defence Staff (CDS) in January this year. But since the post is newly created, the profile and duties of the CDS on a daily basis are still unclear. It is learnt that sometimes Chief of Army Staff General M M Naravane is taken aback when General Rawat talks directly to Army officers on defence matters, going over his head.Waiting in wingsAttorney General K K Venugopal, 89, was keen to step down after his three year tenure ended earlier this year, due to his advanced age. But, he was persuaded to accept a year ''s extension. The government is in talks with senior counsel Harish Salve, currently based in London, to eventually take over the AG ''s post. Salve has impressed Prime Minister Modi after his legal victory on Kulbhushan Jadhav at the International Court of Justice. He charged a token fee of one rupee for the complex case. Salve has requested a grace period of eight months to decide on the offer, as he has some personal work to tie up first.Cup and lip slipThe Congress believed it had sewn up the lone Rajya Sabha seat in Manipur, and would also succeed in toppling BJP Chief Minister N Biren Singh, since it had persuaded a few disgruntled former Congress MLAs who has switched to the BJP to return to its fold. But there is many a slip between the cup and the lip. Thanks to some deft moves by Assam Deputy Chief Minister Himanta Biswa Sarma, Biren Singh survived, at least temporarily. The Congress was so flat footed that it sent Ajay Maken and Gaurav Gogoi as election observers for the Rajya Sabha poll without first finding out the quarantine rules in Manipur. When the observers landed in the state, they were sent into quarantine since they had failed to book return tickets for the same day. The Congress also did not reckon that blood is thicker than water. Though Congress MLA Imo Singh is from an old Congress family, he is the chief minister ''s son in law and took full advantage of the relationship. Imo Singh jumped ship as did several other turncoats. The BJP may have won this round, but the question is how much longer Sarma will remain content to play second fiddle to CM Sarbananda Sonowal in Assam, considering he is the BJP ''s master strategist for the entire Northeast.Veteran ''s victoryWhen the 77 year old Lingayat leader B S Yediyurappa was appointed Chief Minister of Karnataka it was presumed it was a stop gap arrangement and the real power in the state would lie with BJP General Secretary (Organisation) B L Santhosh, who would eventually succeed him. But BSY ''s masterful handling of the Covid pandemic in Karnataka has silenced his critics. Even though Bengaluru is the third largest city in India, its Covid 19 figures and death rate are lower than all other metropolises such as Mumbai, Delhi, Chennai and Ahmedabad. The experienced BSY enlisted the cooperation of the Opposition and the minorities, in the all out war against the disease. The CM heeded the advice of medical experts and senior bureaucrats. Santhosh may have had his way in selecting non entities as BJP candidates for the three Rajya Sabha seats, but BSY remains boss of Karnataka. An impressed Amit Shah consulted the Karnataka CM for advice on how to tackle the pandemic in the National Capital Region.
The brutal torture and death of a father and son in custody in Tamil Nadu brings the issue of police impunity to the fore once again. The deaths were not caused by bullets, which might have been less painful, but by organ damage that shows how merciless the policemen were. The victims were dragged to the police station for a non violent crime a civil offence of keeping the shop open longer than allowed very similar to the George Floyd case in America. But where is India s Floyd moment?Earlier this week, the Maharashtra government reinstated four policemen accused in the custodial death of Khwaja Yunus in 2003. Yunus s mother has filed a contempt of court petition since a suspension done by a court order cannot be legally revoked by the government. Her son, an IT engineer, was taken by the police and never returned. She could not even see his dead body.
Mumbai: Observing that a public servant is duty bound to speak the truth, the Nagpur bench of the Bombay High Court recently ordered Maharastra Police to initiate perjury proceedings against a police officer, who turned hostile in a murder case despite being the sole eyewitness. The HC said it could not be a mute spectator in such cases. A bench of Justices Nitin Sambre and Nitin Suryavanshi said, "Prima facie it is clear from the record that the police officer, being a public servant, was duty bound in law to protect the deceased, who was in his custody. In his presence, in the court premises, the deceased was brutally attacked with weapons and murdered but while deposing before the lower court, he has resiled from his previous statement and tried to support the accused. Thus, a prima facie case is made out against him for perjury and it is expedient in the interests of justice to launch a prosecution."

Do animals have a fundamental right to life ? The question sums up the ethical, environmental, philosophical and legal issues raised by the killing of a pregnant wild elephant in Kerala with explosives hidden in fruit. While animal lovers across India are outraged, the incident is not an isolated one. The jaw exploder device concealed in foodstuffs is the leading cause of elephant deaths in Sri Lanka and is used in India against wild boars and sloth bears. The Uttarakhand High Court upheld animals' right to life in a 2018 order which declared the entire animal kingdom as a legal entity, rather than a chunk of property. As a jurisitic person, animals can be represented by a custodian. The same logic was deployed in the Ram Janambhoomi case, where the idol of Ram Lalla was represented in court by a friend . Earlier, the Uttarakhand High Court had held that rivers, too, were juristic persons (the order was stayed by the Supreme Court).

The Third Report of the National Police Commission noted that nearly 60 % of arrests in India were either unnecessary or unjustified. This report was referred to by the Supreme Court in its decision in the case of Joginder Singh 1 . In the same decision it was emphasised that the police undoubtedly had the power to arrest and interrogate, but that power could not be exercised arbitrarily and capriciously. Realising the need for judicial intervention in such matters, detailed guidelines were formulated by the Supreme Court in the cases of Joginder Singh 2 and D.K.Basu 3 , providing inter alia for the memo of arrest being attested by at least one witness (who would be either a member of the family or a respectable person), the arrested person being made aware of his right to have a close family remember being informed of his arrest, the right of the arrestee to meet his lawyer during interrogation, though not throughout the investigation, the constitutional obligation Article 22(2) to have the arrested person produced before a magistrate within 24 hours and for a medical examination in certain cases. A warning was also issued to the police bringing to their notice that a failure to follow the guidelines would entail being punished for contempt of court. Many of the aforesaid guidelines were incorporated in the statute, by amending the Code of Criminal Procedure by adding Sections 41A to 41D,50A,54A,55A and 60A in the fond hope that the process of arrests would now be more transparent and the arrested persons would have additional safeguards over and above those already provided for in Chapter V of the CrPC.
